i heard that it's fiscal year this september or october... is there any possibility that the retrogression could be lifted after that?

| Some news on the retrogression front: Rep Wexler out of Florida introduced a bill for the emergency nurse relief act. From what I have heard, it looks liek the bill that was introduced last year. Once more information is published, I will post! |

The bill was introduced but a stand alone bill like this usually takes a long time to pass on its own and needs to go through multiple stages of the legislative process. The best hope would be for the bill to be attached to another larger piece of legislation that has a solid chance of passing. If you are waiting to come to the US, the best advice now would be to make sure the firm you are dealing with is contacting their legislatures for support on all measures.

| hi randy good day, i need your advice, im currently holding a tourist visa(multiple entry) and it,s about to expire in sept 2010 im planning to go to the california this coming sept 2009 which is my last trip(which last for 6 months only) i passed all the exams required mainly the nclex, ielts and my rn license here in the philippines and i also have my visa screen certificate. the thing is im planning to look for a sponsor or petitioner in the states i know it would be really hard to find one specially with the crisis going on. i haven't applied in any firms or agency. what are my chances of getting a job or a working visa? your advice will be greatly appreciated. |

If I may add my response as well- it will be very difficult for any hospital to sponsor you; however, we cannot speak for any one hospital in California. I don't want to stir you in the wrong direction, but I think you are better off communicating directly with hospitals in the area of interest (CA) rather than agencies. With agencies, hospitals typically have to pay them a placement fee whereas if you go directly to them, it is considered a direct hire.
Now, having said that, the chances of a hospital sponsoring a visa for you right now is very slim unless there is some type of movement with retrogression or update in immigration. Since you are traveling here in September 09, there may be changes by then.
We do wish you luck, but also want to give you realistic expectations. There aren't any short cuts when it comes to this topic. :) |

| hi anuradha ,from india, here,i have cleared NCLEX IN NOV 2006..n nw i hv my 1-140 approved too,bit becoz of retrogression nothng is happening at all...even my IELTS score r expired on feb 08..so my frnds suggested to apply for australia or NZ ..and that s y i again took IELTS n scored 7.5 overall..in mar 09..i need some advices to which country i can appy..and that also..in less processing tym..money no issue nw...i can arrange lone..dn d do i need agaents again for this...plllzzz help.. |

| If you have a current agent for the US, they should have some global placements for you. If not, you should be able to find an agency doing placements in a country you would like to work in. |

| Hello, We are too on the same position here in texas. I heard that you can apply another I-140 from another hospital and apply I-765 and I-485 at the same time? So you can have your EAD and when time comes 2010 you can just renew your EAD? i dont know how true this is. but what answer did you got from Randy. I was reading your question but there seems to be no answer? |

My best suggestion is to speak with a firm that specializes in change of status. A company such as immigrationsolutions.net can answer your specific questions. Or if you are on assignment through an agency, the agency should be able to give you the correct information. There are too many varibles per each situation to give a quick answer here.

| As of this coming Monday. premium processing applications wll be accepted by the USCIS. Now this doesn't mean anything is moving on the retrogression front, but we will see for October. The Oct bulletin will come out the end of September. We should hopfeully see some movement. |

hi..randy...i need some advices, i got my I-140 approved in 07,but becoz of retrogression m not able to move further and no further processing has been done. Now i got an offer from a agency in india which is giving H1B visa to nurses for US ,and as i have already filied my visa application for EB3 category ,so my question is - Is there any way i can change my visa from EB3 to H1B - or can i apply for both the visas simultaneously. kindly advice regards. |

| All has been quiet on the retrogression front. The larger problem is a lot of the firms here in the US have gone out of business, so the support and the lobbying money has dropped. Two big areas to keep an eye on though: 1) The economy 2) the healthcare reform. Both could have a positive impact on retrogression being lifted. |

| The October bulletin was released and had very little movement. Right now it is honestly a guessing game on which direction movement happens. EB3 was made available but is set back to 2001 and 2002 for most countries. I wish I had better news but all we can do is see the movement month over month. |

Hi, I am currently working in a hospital in CA with my OPT, which will end by December, 2009. I wonder if I should file the I-140 as one of my co-workers, who is also in the same situation as I am, did. Do you think it's worth spending couple thousand bucks to file for the paperwork? Also, I am going back to school for my advance degree. I am thinking of doing NP. I wonder how easy it is to get a job once I am done with that program? Also, how easy it is to obtain a visa with an advance degree? Thanks in advance. |

I work here in London-UK more than 8years. Pls help..I have a pending I140 petition in one of the hospital in california. My employer sponsored me with no obligation to pay for my lawyer. I have settled all my payments and basically waiting for retrogression to end. I want to know if i coud still apply for an H1B petition-working permit while waiting for my I140. I heard some hospital in the US are still sponsoring for H1B. Thank you. |
